These Terms of Use (“Terms”) are a binding agreement between you and EquipMeFi, LLC (“EquipMeFi,” “we,” “us,” or “our”). They govern your access to and use of equipmefi.com and any related pages, forms, application workflows, document-upload tools, support features, communications, and services that link to these Terms (collectively, the “Services”).
01 Acceptance and Eligibility
By accessing or using the Services, you acknowledge that you have read, understood, and agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.
- You must be at least 18 years old and legally capable of entering into a binding agreement.
- If you use the Services for a company or other organization, you represent that you have authority to bind that organization to these Terms.
- The Services are intended primarily for users located in the United States. You are responsible for ensuring that your use is lawful where you are located.
02 Our Services and Role
EquipMeFi provides business-financing support, application-intake technology, document collection, educational content, referral services, and access to a network of independent financing providers. Certain marketplace features may be identified as “coming soon” and are not available until formally launched.
Unless expressly stated otherwise in a separate written agreement, EquipMeFi is not the lender or creditor making a financing decision. Independent financing providers determine eligibility, approvals, rates, fees, repayment obligations, collateral requirements, and final terms.
Submitting an inquiry or application does not guarantee an offer, approval, specific rate, funding amount, funding date, or financing outcome.
Website content is provided for general informational purposes and does not constitute legal, tax, accounting, investment, or individualized financial advice. You should consult your own professional advisers when appropriate.
03 Applications and Information You Provide
You agree to provide accurate, current, complete, and non-misleading information. You must promptly correct information that changes or becomes inaccurate.
- Only submit information and documents that you are authorized to provide.
- Use the designated secure application and upload tools for bank statements, identification, and other sensitive records. Do not send sensitive financial documents through a general contact form.
- You authorize us to use and disclose submitted information as described in our Privacy Policy, the application disclosures you accept, and any specific authorization presented during the application process.
- Any business or personal credit review will be subject to a separate authorization when required by applicable law or the financing provider.
- We may contact you to clarify information, request documents, provide support, or communicate about your inquiry or application, subject to your communication choices and applicable law.
We may decline, pause, or close an incomplete, inconsistent, unverifiable, suspicious, or potentially unlawful submission.
04 Independent Financing Providers and Third Parties
Financing providers, banks, non-bank finance companies, vendors, and other third parties are independent from EquipMeFi. Their products, decisions, websites, privacy practices, agreements, and conduct are governed by their own terms.
- You are responsible for reviewing and understanding every financing agreement before accepting it.
- Rates, fees, repayment schedules, prepayment provisions, security interests, guarantees, and other costs are determined by the applicable provider.
- A link, referral, introduction, or integration does not mean that EquipMeFi controls or guarantees a third party.
- Any dispute concerning a provider’s final financing agreement must be addressed under that agreement, while concerns about EquipMeFi’s Services remain subject to these Terms.
05 Electronic Communications and Signatures
When you use the Services, provide an email address or telephone number, or consent to electronic records, you agree that we may provide notices, disclosures, records, and communications electronically, including by website display, email, text message, or other permitted electronic means.
You are responsible for maintaining a valid email address and mobile number, suitable hardware and software, and the ability to access and retain electronic records. An electronic action, typed signature, checkbox, or similar method may have the same legal effect as a handwritten signature where permitted by law.
You may request information about withdrawing electronic-consent preferences by contacting us. Withdrawal may limit your ability to use an online application or receive time-sensitive communications.
06 Mobile Messaging and 10DLC SMS Terms
This section governs the EquipMeFi mobile messaging program, including application alerts, document reminders, support responses, status updates, and any promotional messages for which you provide separate consent.
Your choice, clear controls.
How You Opt In
You enroll only through a clear consent method presented by EquipMeFi, such as checking an unchecked consent box next to an SMS disclosure, completing another documented opt-in flow, or initiating a message where the program instructions permit. Merely providing a telephone number does not authorize marketing texts unless the accompanying disclosure clearly states that consent.
Consent and Number Ownership
You represent that you are the subscriber or customary user of the mobile number provided and are authorized to consent to messages at that number. You agree to notify us promptly if the number changes, is reassigned, or is no longer yours.
Message Content and Frequency
Messages may include application confirmations, status information, missing-document reminders, support follow-ups, scheduling messages, service notices, and other communications related to your relationship with EquipMeFi. Promotional or marketing messages will be sent only when supported by the consent collected for that purpose. Message frequency varies based on your application activity, requests, and selections.
Opting Out
You may revoke SMS consent at any time by replying STOP. We also recognize common opt-out keywords such as END, CANCEL, UNSUBSCRIBE, and QUIT. After an opt-out request, you may receive one final confirmation message. We will honor the request as soon as reasonably practicable and within the time required by applicable law. You may also request removal by contacting support.

Charges, Delivery, and Carrier Disclaimer
Message and data rates may apply according to your wireless plan. EquipMeFi does not charge a separate fee solely to receive program texts. Wireless carriers are not liable for delayed or undelivered messages. Delivery is subject to carrier availability, network conditions, device compatibility, and other factors outside our control.
Mobile Data Privacy
We do not sell, rent, or share text-messaging originator opt-in data and consent with unaffiliated third parties for their own marketing or promotional purposes. Mobile information may be disclosed to service providers that help us deliver messages, to financing or operational partners as otherwise authorized and described in our Privacy Policy, or when required by law. All other sharing categories exclude SMS opt-in data and consent except as necessary to provide the messaging service or comply with law.
Program Changes
We may modify or discontinue the messaging program, change the sending number, or update these SMS terms. Material changes will be communicated as required. Your decision to opt out will not prevent non-SMS communications that are otherwise permitted, such as email responses to an inquiry.
07 Acceptable Use
You may use the Services only for lawful, authorized purposes. You may not:
- Submit false, fraudulent, deceptive, stolen, or unauthorized information or documents;
- Impersonate another person or business, misrepresent authority, or interfere with identity-verification procedures;
- Attempt to bypass security, access non-public systems, introduce malware, overload the Services, or disrupt another user’s access;
- Scrape, harvest, copy, reverse engineer, or use automated tools against the Services except with our prior written permission;
- Use the Services to violate privacy, intellectual-property, consumer-protection, anti-spam, lending, sanctions, export-control, or other laws; or
- Use content from the Services to build a competing service or mislead others about an affiliation with EquipMeFi.
08 Intellectual Property
The Services, including the EquipMeFi name, logos, designs, text, graphics, software, workflows, and other content, are owned by or licensed to EquipMeFi and are protected by intellectual-property laws.
We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Services for their intended purpose. No other rights are granted. You may not use our trademarks, branding, or copyrighted materials without prior written permission.
If you voluntarily provide feedback or suggestions, you authorize us to use them without restriction or compensation, provided we do not publicly identify you without permission.
09 Privacy and Security
Our collection, use, retention, and disclosure of personal information are described in our Privacy Policy and in any application-specific disclosures. You are responsible for protecting access to your devices, email, telephone number, and any application-resume information.
We use administrative, technical, and organizational measures designed to protect information, but no website, transmission method, or storage system can be guaranteed to be completely secure. Notify us promptly if you suspect unauthorized access or misuse.
10 Disclaimers
To the fullest extent permitted by law, the Services are provided on an “as is” and “as available” basis. EquipMeFi disclaims warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, uninterrupted availability, and freedom from harmful components.
We do not warrant that every financing provider will review an application, that information will always be error-free, that the Services will be continuously available, or that third-party products will meet your needs. Some jurisdictions do not allow certain warranty exclusions, so portions of this section may not apply to you.
11 Limitations of Liability
To the fullest extent permitted by law, EquipMeFi and its members, managers, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits or revenue; lost data; business interruption; reputational harm; or losses arising from third-party financing decisions or agreements.
To the fullest extent permitted by law, our aggregate liability arising from the Services or these Terms will not exceed the greater of (a) the amount you paid directly to EquipMeFi for the specific Service giving rise to the claim during the 12 months before the event, or (b) one hundred U.S. dollars ($100).
These limitations apply regardless of the legal theory and even if a remedy fails of its essential purpose. They do not exclude liability that cannot lawfully be limited.
12 Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless EquipMeFi and its members, managers, employees, contractors, affiliates, and service providers from claims, losses, liabilities, damages, judgments, and reasonable costs arising from your unlawful or unauthorized use of the Services, information you submit, violation of these Terms, or infringement of another person’s rights.
13 Dispute Resolution and Governing Law
Before filing a formal claim concerning EquipMeFi, you agree to send a written notice describing the issue and requested resolution to support@equipmefi.com and allow 30 days for a good-faith attempt to resolve it.
These Terms are governed by the laws of the State of Nevada, without regard to conflict-of-law principles. Unless applicable law requires otherwise, any court proceeding concerning EquipMeFi or these Terms must be brought in the state or federal courts located in Clark County, Nevada, and you consent to their jurisdiction and venue.
14 Suspension and Termination
We may restrict, suspend, or terminate access to the Services when reasonably necessary to protect users, investigate suspected fraud or misuse, comply with law, enforce these Terms, address security or operational risks, or discontinue a feature.
You may stop using the Services at any time. Provisions that by their nature should survive—such as intellectual-property, disclaimers, liability limitations, indemnification, and dispute provisions—will remain effective after termination.
15 Changes and General Provisions
We may update these Terms to reflect changes in the Services, law, technology, business practices, or compliance requirements. The updated version will display a revised “Last Updated” date. When required, we will provide additional notice or obtain renewed consent.
If a provision is held unenforceable, the remaining provisions remain in effect. A failure to enforce a provision is not a waiver. You may not assign your rights under these Terms without our written consent; we may assign these Terms in connection with a reorganization, financing, merger, acquisition, asset transfer, or similar transaction. These Terms and incorporated policies are the entire agreement governing the Services unless a separate written agreement applies.
